The short version
- You keep ownership of everything you create and upload. You give us permission to store, process and show it as far as needed to run Linx for you.
- Upload only what you have the right to use, and follow the Acceptable Use Policy.
- You are responsible for what happens under your account, including access tokens and the AI assistants you connect.
- Linx is provided “as is”, and our liability is limited as set out in Limits of liability.
- Either of us can end the agreement at any time. We may suspend an account that puts the service or other people at risk.
- If these terms change in a way that matters, we tell you before the change takes effect.
About these terms
These Terms of Service (“Terms”) are an agreement between you and Brown Linx (“we”, “us”). They apply when you visit our website, create an account or use Linx: the workspace, the design library, the embeddable personalizer, the API and the connection for AI assistants (together, the “Service”).
By creating an account or using the Service you accept these Terms. If you do not accept them, do not use the Service. If you use the Service for a company or another organization, you confirm that you have the authority to bind it, and “you” then includes that organization.
You must be old enough to enter a contract where you live. The Service is not for children under 16.
Our Privacy Policy, Cookie Policy and Acceptable Use Policy are part of these Terms.
The Service
Linx lets online stores add personalization to products. Shoppers change text, images and options and see the result live, and the Service produces print-ready files that a store sends to its print provider. You can also build design templates, upload mockups, publish designs in a public library and, if you connect one, let an AI assistant help you build templates.
We work to keep the Service available and accurate, but we do not promise that it will be uninterrupted or free of errors. Parts of it are marked “Soon” or “Early access”; those may be incomplete, change or be withdrawn.
A preview is an approximation. Colors on a screen differ from colors on a product, and the printed result depends on the print provider and the process. Check a proof before you sell.
We may change, add or remove features. If a change significantly reduces what a paid plan includes, we will tell you in advance.
Your account
Give us accurate information and keep it up to date. Keep your password and access tokens secret. You are responsible for everything done through your account, including by AI assistants and apps you connect and by people you let in. Tell us at once if you think someone else has used your account.
Do not share one account between several people, and do not create accounts to get around a limit or a suspension.
Your content
Your content is what you create, upload or connect: templates, designs, artwork, text, mockups, previews and settings. You keep all rights in it.
You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, render, display and transmit your content, and to make previews and print files from it, only as far as needed to provide and secure the Service for you. This includes sending print files to the print provider that you or your store choose. The license ends when your content is deleted from the Service, apart from backups kept for a limited time and copies that others have already received.
If you publish a template in the Design library, or propose one and we accept it, you also allow us to show it, with its name and picture, to the public on the Service and to let visitors personalize it on screen. You can ask us to remove it at any time.
You promise that you own your content or have every right needed to use it and to give us the license above, and that using it with the Service, and selling products made from it, does not infringe anyone’s rights or break the law. This includes copyrights, trademarks, brand logos, licensed characters and people’s rights in their own image.
We do not review content in advance and are not responsible for it. We may remove content or restrict access to it if it breaks these Terms or the Acceptable Use Policy, or if the law requires.
Your store and your shoppers
If you add Linx to a store, you decide what shoppers may upload and which print provider receives an order. You are responsible for your store: its terms, its privacy notice, the products you sell and what your shoppers upload, including having the rights and consents needed for photos of people.
You must tell your shoppers that what they enter is processed by Linx. How we handle it is described in the Privacy Policy. Your agreement with a print provider, with a platform such as Shopify or with anyone else is between you and them, and we are not responsible for what they do.
Acceptable use
You agree to follow the Acceptable Use Policy. In short: no illegal, infringing, hateful or harmful content, and no abuse of the Service: no attempts to break, probe or overload it, and no scraping beyond what the API allows.
AI assistants and integrations
You can connect AI assistants and other apps to your account. When you do, you allow them to act in your account within the permissions you grant, and what they do counts as done by you. Review what an assistant creates before you publish or sell it.
Assistants are run by other companies under their own terms and privacy policies. We do not control them or what they produce. You can disconnect an assistant or revoke a token at any time in your account.
Fees and trials
Plans and prices are shown on the Pricing page. A free trial, where one is offered, lasts for the period shown there, and we explain what happens at its end before it ends. Prices are in US dollars and do not include taxes unless we say so; you are responsible for the taxes that apply to you.
If a fee applies to your plan, you agree to pay it, and we will show you the price before you are charged. We may change prices for future periods; we will give you notice before a change reaches you, and you can cancel before it takes effect. Fees already paid are not refunded, except where the law requires it or where we say otherwise when you buy.
Paid plans are not being charged yet. Before any payment is taken we will update these Terms to describe how payment, renewal and cancellation work.
Our rights
The Service, including its software and design and the Linx name and logo, belongs to us or our licensors. We give you a limited, non-exclusive, non-transferable right to use the Service under these Terms. You may not copy, modify, resell or reverse engineer it, except where the law allows it despite this restriction. The Service includes open-source software that is covered by its own licenses.
If you send us ideas or feedback, we may use them freely, without payment or credit.
Privacy
We handle personal data as described in the Privacy Policy. If you use the Service to process personal data about your shoppers, you can ask us for a data-processing agreement: contact us.
Suspension and ending
You can stop using the Service at any time. To close your account and have your data deleted, contact us.
We may suspend or end your access straight away if you break these Terms, if your use puts the Service or other people at risk, or if the law requires it. We will give notice first where we reasonably can. We may also end the Service or a part of it; in that case we will give reasonable notice and a chance to export your content.
When your access ends, your right to use the Service ends and we delete your content as described in the Privacy Policy. Sections that by their nature should survive, such as ownership, disclaimers, limits of liability and governing law, continue to apply.
Disclaimers
The Service is provided “as is” and “as available”. To the extent the law allows, we give no warranties, express or implied, including about quality, fitness for a particular purpose, the accuracy of previews, or that the Service will be uninterrupted or free of errors. We are not responsible for the products you sell, for print providers or for AI assistants.
Nothing in these Terms takes away rights that the law gives you as a consumer and that cannot be excluded.
Limits of liability
To the extent the law allows, we are not liable for indirect or consequential loss, or for lost profits, revenue, data or goodwill, or for loss caused by print providers, by other services, or by content that you or your shoppers provide.
Our total liability for all claims about the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the claim and 100 US dollars.
Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, for fraud or for willful misconduct.
If someone makes a claim against us
If you use the Service for business, you will defend us against claims by third parties, and cover the resulting losses and costs (including reasonable legal fees), when they arise from your content, your products or your store, from your breach of these Terms, or from your misuse of the Service. We will tell you promptly about such a claim and let you take part in the defense. This section does not apply to consumers.
Changes to these terms
We may update these Terms. If a change matters, because it reduces your rights or adds obligations, we will give notice at least 14 days before it takes effect, on this site or in your workspace, and show the new date at the top of this page. If you keep using the Service after that, you accept the new Terms. If you do not agree, stop using the Service and ask us to close your account.
Changes that the law requires, that correct an error or that add a feature may take effect immediately.
Governing law and disputes
These Terms are governed by the law of the place where Brown Linx is established, without regard to its conflict-of-law rules, and the courts of that place have jurisdiction, unless the law gives you the right to go to the courts where you live.
If you are a consumer, you keep the protection of the mandatory laws of the country where you live. Before going to court, please contact us and give us a chance to put the problem right.
General
These Terms, together with the policies they refer to, are the whole agreement between us about the Service. If a part of them is held unenforceable, the rest stays in force. If we do not enforce a right, that is not a waiver of it. You may not transfer your rights under these Terms without our consent; we may transfer ours as part of a business transfer. We may give you notice on this site, in your workspace or by email where we have your address. If a translation differs from the English text, the English text prevails.
